Federal Investigation Underway for Vermont’s Abortion Insurance Coverage Law

The U.S. Department of Health and Human Services has initiated an inquiry into a piece of legislation in Vermont mandating that health insurance providers cover abortion services. This law is part of an investigation encompassing 13 states during the current administration.

On Wednesday evening, the Vermont Department of Financial Regulation acknowledged receipt of a letter from federal authorities, which set a 20-day deadline for the state to respond. The law in question compels health insurers to include coverage for abortions and related services, although the correspondence did not discuss Vermont’s additional abortion shield laws or its constitutional amendment affirming the right to reproductive autonomy.

In a response to the investigation, the Commissioner of the Vermont Department of Financial Regulation expressed unwavering support for both the law and the protections it provides to residents. The department is currently analyzing the notice and collaborating with other state agencies to formulate an appropriate reply. They assert that they have not unlawfully coerced or discriminated against any insurance company regarding abortion coverage.

Federal officials cited a recent alteration in their understanding of the Weldon Amendment, which prohibits the federal government from providing assistance to organizations that restrict the ability of health providers or insurers to address abortion services. A past letter during President Joe Biden’s administration had taken a different approach to this amendment, allowing employers and plan sponsors to categorize abortion coverage as an essential aspect of healthcare provision.

Under the current leadership of Robert F. Kennedy Jr.’s Health and Human Services Department, this interpretation has been overturned. The latest communication advised states that they should disregard the previously accepted legal viewpoint established by the Biden administration.

A representative from HHS indicated concerns regarding individuals and employers who oppose abortion and prefer not to include such services in health insurance plans. The latest letter from the federal agency requires Vermont to clarify how the law is enforced and identify potential exemptions.

Should the Health and Human Services Department identify any issues concerning state compliance with the Weldon Amendment, attempts will first be made to resolve the situation informally before any formal enforcement actions are considered. This could involve withholding funding or referring the matter to the U.S. Department of Justice.

The Vermont Attorney General confirmed the state’s commitment to defending the constitutional rights of residents regarding access to abortion and stated that her office is actively involved in supporting the Department of Financial Regulation as necessary.

Meanwhile, a spokesperson for BlueCross BlueShield of Vermont mentioned that the insurer had already included abortion coverage prior to the legislative requirement in 2023, and they do not foresee any changes due to the investigation.

Unlike Vermont, numerous states have implemented outright bans on abortion coverage by insurers. If no restrictions are in place, insurance offerings for abortion remain at the discretion of employers and plans.
