Judge permits accused to part ways with defense attorney, pushing back April trial

A Windham County judge has allowed Lavadus Williams Jr. to terminate his court-appointed lawyer, leading to a delay in his scheduled trial for April related to the June 2024 murder of 25-year-old Aaron Colburn near the Brattleboro Transportation Center.

The decision from Judge Michael Kainen came during a short hearing, where he ascertained that Williams was fully informed of the implications of his choice, despite having been warned about the possible consequences. Although defense attorney David Sleigh, known for his extensive experience in criminal law, expressed best wishes for Williams, he opted not to provide further remarks after the judge’s ruling.

In the course of the hearing, Kainen emphasized the potential risks associated with switching legal representation so close to the trial date. He pointed out that many defendants may react negatively when confronted with unwelcome legal guidance. Kainen advised Williams to refrain from disclosing any confidential discussions he had with Sleigh. The judge made it clear that hiring a new attorney would delay proceedings and lead to the removal of the April trial from the calendar. He also cautioned Williams against making repeated requests for changes in counsel once a new attorney is assigned.

Williams, 20, is facing charges of second-degree murder and aggravated assault stemming from the stabbing incident involving Colburn on June 20, 2024. Law enforcement reports indicate that footage from nearby surveillance showed the two individuals arguing outside the transportation center just before 11 p.m. Colburn reportedly walked away from the confrontation, only to return toward Williams, who then pushed him and used a knife to inflict a single stab wound. Colburn fell in the crosswalk and later succumbed to his injuries at Brattleboro Memorial Hospital.

Previously, Sleigh had indicated an intention to argue self-defense and was in the process of interviewing several witnesses. The state has confirmed that all evidence gathering in the case has concluded.

Williams, a resident of Brattleboro at the time of the incident and originally from Saxtons River, has remained in custody without the option for bail since his arraignment. Earlier this year, the homicide case transitioned from juvenile court, though those details remain private. The court is set to appoint a new attorney, but a new trial date has yet to be determined.
