Vermont Attorney General Settles with Mental Health Provider for $483,464 Due to Safety Issues

The attorney general of Vermont has finalized a settlement amounting to $483,464 with a mental health care organization in Bennington County, addressing allegations of significant safety breaches. This resolution followed an extensive inquiry regarding persistent failures in service and supervision by United Counseling Service.

The investigation commenced after a complaint was lodged by the Vermont Department of Disabilities, Aging and Independent Living-Developmental Disabilities Service Division. Documents revealed that United Counseling Service had not appropriately managed the care and oversight of certain clients with developmental disabilities, some of whom presented risks to public safety due to troubling behavioral issues.

Finding that the leadership was aware of these shortcomings yet chose not to rectify them, officials indicated that UCS had created notable risks for the community, especially among Medicaid beneficiaries.

As part of the settlement, besides the monetary compensation, UCS is mandated to carry out significant organizational changes. These reforms include the appointment of an external monitoring body, hiring a new director responsible for quality management in daily operations, and committing to public disclosures regarding remedial actions for a three-year period.

Additionally, the Department of Disabilities, Aging and Independent Living has terminated its contracts with UCS and plans to redirect patients to alternative service providers.
